Failed Window Seal or Bad Installation: Who’s Responsible?

How do you sort out whether a window problem belongs with the manufacturer or the installer?
I’m trying to understand the usual process for a replacement window that’s roughly 5 to 10 years old. The symptoms could be a failed insulated-glass seal, a noticeable draft, water appearing at the interior trim during rain, or a sash that no longer operates smoothly. Those sound similar from the homeowner’s perspective, but they may point to very different responsibilities.
My understanding is:
- Fogging or moisture between the panes may be an insulated-glass-unit warranty issue.
- Air leakage, water intrusion around the frame, poor shimming, or an opening that was never sealed correctly may be installation workmanship.
- A sticking sash could be hardware, frame distortion, installation, or normal wear, depending on the circumstances.
The tricky part is that the window brand may cover replacement glass or parts but not labor, while the installer’s workmanship warranty may have expired or may be written separately in the contract. Some contracts also seem to distinguish between the manufacturer’s product warranty and the installer’s labor warranty, which makes it easy to get bounced from one department to the other.
For those who’ve dealt with this, what documentation helped most? I’m thinking of the original invoice, the window’s approximate installation date, model or serial information, photos or video showing the symptom, and notes about whether the problem happens only during wind-driven rain or in all weather.
Did you first contact the installer, the manufacturer, or both? And if the installer blamed the window or the manufacturer blamed installation, how did you get a clear inspection and responsibility decision instead of just another referral?
